What would be the reason to continue processing personal data via the "Cold Email Follow Up" if the user hadn't responded to the first? You certainly don't have explicit consent and I can't see it being legitimate interest, either.

Great stuff. BTW, can we get the text of the legally-valid GDPR opt-in form? I saw a reference to it in the body of the email but I couldn't find the form itself anywhere. On a side note, though not totally relevant to the present context, Digiday reports that the German publisher Axel Springer tried out various GDPR opt-in forms on its website. Apparently, the version of text that delivered the highest conversion rate of readers-to-consentors reads as follows: “The website uses cookies, web beacons, JavaScript and similar technologies. I agree that companies belonging to Axel Springer SE and trusted partners generate pseudonymous user profiles for adapting the website to the user, for market research and for advertising. The generated data can also be shared with third parties while the user profiles cannot be combined with personal data. Copy has an error. Says "need you yo opt-in" instead of "need you to opt-in" on the template, Marketing - Request to update your data.
