Quick question? Do you need a cookie banner if you are using anonymous tracking via google analytics?

@sentry_co if you are using GA with all of its anonymization features, you may be in the clear. The challenge, of course, is whether or not some day it is ruled that Google's anonymization features are still logging personal data or constitute a sale. We have seen many instances in which Google claims to and or believes to be operating on the right side of data privacy, only to be ruled otherwise in Europe. I'd imagine in all practical cases you are fine. But I'd argue why not implement a light weight simple privacy program to be increasingly sure. Why rely on the kindness of strangers?

@maxwell_anderson ATM We reverse engineered GA sdk to be sure google isn't collecting any identifiers they should not be collecting. We made this: https://github.com/sentryco/Tele... And we generated all of the privacy documents etc via GPT. When you say privacy program, beyond the cookie banner do you offer?

@sentry_co I I see. That makes sense. Without looking into the repo and digging in, I couldn't say much more than I have already, but I would imagine you are far beyond the average company in terms of limiting your tracking. With that said, I come from the perspective that companies can and should collect personal data as long as they do so legally, and responsibly. One downside to taking the approach you are taking (I assume), is that you are limiting the collection categorically across jurisdictions. One of the benefits of Ketch is that you can dynamically adjust your collection practices based on the requirements of a specific region. Of course, that is up to you, but just throwing that out there. Beyond a cookie banner, we offer customer support in collecting and fulfilling data subject rights, delivering privacy reports like a data map, ROPA (required in Europe), conducting risk assessments and managing risk, and a few more areas. @maxwell_anderson Aha I see. Compliance monitoring as a service! That's very useful actually! It's getting increasingly more complex to adjust everything and not mess something up. Definitely will need something like this down the line. What about adding a hock into GitHub action? And get a notification if privacy / legal docs are out of date or something changed? For every release we do, we go through a GitHub action that takes care of unit/UI testing, and checking various things before it's pushed to the app-store for review by apple employees. Some hock for legal compliance would be immensely useful. And a great way to upsell more advance monitoring etc.

@nick_kessler Hah! Short answer, YES. While the EU is subject to GDPR, the U.S. state privacy law landscape is extremely fragmented. There is no federal regulation, so data privacy laws are being passed on a state-by-state basis. It's near impossible to keep up with the changes! That's why a solution like Ketch Free is so invaluable to website owners with customers in the U.S. Ketch does the work for you, serving the right privacy banners, to the right people, in the right locations.

@nick_kessler Ha! The US has about as many privacy laws as Chick-Fil-A does condiments. There are currently 5 states with enforceable privacy regulations: California, Colorado, Connecticut, Utah and Virginia. 7 other states have passed legislation with enforcement dates coming in 2024 and 2025. Even more of a reason to get something like Ketch Free in place today.

@maxwell_anderson Hi Max, great initiative! 👋 Ketch sounds like a game-changer for ensuring data privacy compliance. How did the idea for Ketch come about, and what challenges did you face in developing a no-cost solution for businesses?

@cata great question. My co-founders and I came up with the idea at Salesforce. In 2016 GDPR was looming and Salesforce had just acquired our prior company, Krux. Once there, we were tasked with delivering the data privacy features inside of the Marketing Cloud. In short, we built this product for our former selves. We wished we had it back then and hope it's useful to the community now. The biggest challenge for me is abstracting away the really gnarly parts of data privacy for someone who doesn't fully grock them, not want to. Everyone thinks data privacy is a cookie banner, but of course it's more than that. What happens when someone says "don't use my data for analytics"? Collection of the choice is first, but how do you respect it across dozens of SAAS apps and internal data platforms? Solving that problem is hard, and making it easy for someone to use a product to solve that problem is even harder.
